The high-stakes legal battle between Elon Musk and OpenAI has pulled back the curtain on a 2017 power struggle that redefined the trajectory of artificial intelligence. Recent testimony from OpenAI President Greg Brockman, supported by his private journals, paints a picture of a partnership that disintegrated over ego, control, and the realization that achieving AGI would require billions in capital.
The August 2017 Breaking Point
In late August 2017, the leadership of what was then a small nonprofit research lab met to discuss a for-profit pivot. Musk, seeking “unequivocal” control, attempted to sway his co-founders by gifting them Tesla Model 3s. The gesture failed to buy loyalty. When the team refused to grant him absolute authority, Musk reportedly stormed out of the meeting, even snatching away a gift—a painting of a Tesla—commissioned for him by Ilya Sutskever.
Compute, Cash, and Conflict
The drive toward a for-profit model was sparked by OpenAI’s victory in the video game DOTA II. This milestone convinced Brockman and Sam Altman that massive compute power was the only path to success—a resource the nonprofit structure couldn’t sustain. While Musk proposed merging OpenAI with Tesla or taking personal charge, the other founders feared a single-leader dictatorship.
The “Stolen Charity” Allegation
Musk’s legal team argues that Altman and Brockman effectively “stole a charity.” They point to Brockman’s journal entries, where he pondered if converting to a B-corp without Musk would be “morally bankrupt.” Brockman defended these notes as private reflections on board governance, not a confession of theft.
A Legacy of Success and Spite
Musk eventually departed in 2018, predicting OpenAI’s “certain failure.” Instead, the company secured a transformative partnership with Microsoft, raising over $13 billion and achieving a valuation that has minted billionaires. Brockman testified that Musk simply failed to recognize the “spark” of early AI models, including the tech that would become ChatGPT. Today, while Neuralink and Tesla pursue their own AI paths, the rift remains a multi-billion dollar legal spectacle.
